Terms of Use
VialCue is a personal recordkeeping and general educational tool for adults. It is not a medical service.
1. Agreement and eligibility
By accessing the VialCue website or using the iOS app, you agree to these Terms and our Privacy Policy. You must be at least 18 years old. If you do not agree, do not use VialCue. Apple’s standard Licensed Application End User License Agreement applies to the iOS app to the extent required and not inconsistent with these Terms.
2. Medical and safety boundary
VialCue does not provide medical advice, diagnosis, treatment, prescribing, monitoring, clinical interpretation, or emergency services. It does not calculate, validate, select, recommend, or change a dose, schedule, product, medicine, combination, treatment, protocol, or injection site. It records information you enter and presents general educational material.
Always verify medical decisions, product instructions, schedules, and amounts with a licensed clinician or pharmacist and the approved materials that apply to you. Do not delay or disregard professional advice because of VialCue. Do not use VialCue for emergencies.
Content discussing research or products labelled “research use only” is informational. Such a label does not mean a product is approved, verified, or safe for human use. VialCue does not encourage or endorse human use of research products.
3. Your information and responsibility
You control the information you enter and are responsible for its accuracy, legality, and appropriateness. Protect your device and exported files. Do not rely on VialCue as the only copy of information you need. The app may reflect incorrect or outdated information if you entered it incorrectly or did not update it.
4. Limited licence
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use VialCue for lawful, non-commercial personal use. You may not copy, sell, sublicense, reverse engineer except where law prohibits that restriction, remove notices, interfere with the service, or use VialCue to violate law or another person’s rights.
5. Intellectual property and third-party rights
VialCue’s software, original content, branding, interface, artwork, and documentation are protected by applicable intellectual-property laws. Third-party trademarks, research, sources, and other materials remain the property of their respective owners. Reference to a third party does not imply affiliation or endorsement. See our Trademark & Independence Notice.
6. Availability and changes
We may improve, change, suspend, or discontinue features, subject to applicable law. We aim to maintain an accurate and supported product, but do not guarantee uninterrupted availability, compatibility with every device, or preservation of local data after device loss, corruption, deletion, or operating-system changes.
7. Disclaimers
To the maximum extent permitted by law, VialCue is provided “as is” and “as available,” without express or implied warranties, including merchantability, fitness for a particular purpose, accuracy, non-infringement, or uninterrupted operation. Educational material is general and may become outdated. Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.
8. Limitation of liability
To the maximum extent permitted by law, VialCue and its operators will not be liable for indirect, incidental, special, consequential, exemplary, or punitive losses; loss of data, revenue, opportunity, or goodwill; or reliance on app records or educational content. Where liability cannot be excluded, it is limited only to the extent permitted by applicable law. Nothing limits liability that cannot legally be limited.
9. Indemnity
To the extent permitted by law, you agree to be responsible for claims and reasonable costs arising from your unlawful misuse of VialCue, violation of these Terms, or infringement of another person’s rights.
10. Governing law
These Terms are governed by the laws of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law rules, except where mandatory consumer law requires otherwise.
11. Changes to these Terms
We may update these Terms. The effective date above will change, and additional notice will be provided where required. Continued use after an effective update means you accept the revised Terms, except where law requires another form of consent.
